Processing and protection of personal data

1. General provisions

This Privacy Policy (hereinafter referred to as the "Policy") defines the procedure for collecting, storing, using, transferring and protecting personal data of users of the new-balance.pl online store (hereinafter referred to as the "Site").

The Policy applies to individuals who visit the Site, place orders, contact support, subscribe to newsletters, or otherwise provide us with their personal data.

Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as GDPR or RODO, the Polish Act of 10 May 2018 on the Protection of Personal Data and other applicable Polish and European Union legislation.

No separate consent is required for the processing of data necessary for the processing and fulfillment of an order. Consent is only requested where it constitutes a valid legal basis, such as for marketing communications and the use of optional cookies.

3. What personal data do we collect?

When using the Site, placing and fulfilling an order, we may collect the following categories of personal data:

  • last name and first name;
  • phone number;
  • email address;
  • residential or delivery address;
  • branch number, post office box or other data necessary for delivery of the order via Nova Post;
  • order information, including the list of products, size, cost, status and purchase history;
  • payment information and payment status;
  • content of appeals, correspondence and messages to the support service;
  • technical data, including IP address, browser type, operating system, device type, date and time of visit, event logs and information about activity on the Site;
  • cookie settings and marketing consents provided.

We do not store full credit card details. Such data is processed by banks, payment institutions or other payment service providers in accordance with their own privacy and security policies.

4. Purpose and legal basis for data processing

We process personal data for the following purposes and on the following legal grounds:

  • Order processing and fulfillment - processing is necessary for the conclusion and performance of a sales contract in accordance with Article 6(1)(b) of the GDPR.
  • Arrangement of payment and delivery of goods - processing is necessary for the performance of the contract pursuant to Article 6(1)(b) of the GDPR.
  • Processing of returns, exchanges, complaints and appeals - performance of the contract, legal obligations and protection of the legitimate interests of the administrator in accordance with Article 6(1)(b), 6(1)(c) and 6(1)(f) of the GDPR.
  • Fulfillment of accounting, tax and other legal obligations — Article 6(1)(c) GDPR.
  • The establishment, exercise or defense of legal claims is the legitimate interest of the administrator pursuant to Article 6(1)(f) of the GDPR.
  • Ensuring the security of the Site, preventing fraud and technical abuse is the legitimate interest of the administrator in accordance with Article 6(1)(f) of the GDPR.
  • Analysis of the operation and improvement of the Site - legitimate interest of the administrator or user consent if the analysis is carried out using optional cookies.
  • Sending advertising messages, information about promotions, new products and special offers is only based on voluntary consent in accordance with Article 6(1)(a) of the GDPR.

Providing the data required for processing, payment and delivery of an order is voluntary, but without this data we will not be able to accept or fulfill the order. Providing data for marketing purposes is completely voluntary and does not affect the possibility of purchasing goods.

5. Transfer of data to other recipients

We do not sell users' personal data. Data may be transferred only to the extent necessary for the operation of the Site, fulfillment of an order, or fulfillment of legal obligations.

Recipients of personal data may be:

  • Nova Post, Nova Poshta and their logistics partners - for international transportation and delivery of orders from Ukraine to Poland;
  • banks, payment institutions and post-payment operators - for accepting and confirming payment;
  • providers of hosting, server infrastructure, software, CMS, email and technical support;
  • providers of analytical and advertising tools - only if there is an appropriate legal basis and the necessary user consent;
  • accountants, auditors, legal consultants and other professional advisors;
  • government, tax, judicial, law enforcement and supervisory authorities - if the transfer of data is required by applicable law.

Recipients of data are obliged to process them in accordance with the law, concluded contracts and appropriate confidentiality and security requirements.

6. Data transfer outside the European Economic Area

Since the administrator is registered in the United States of America and orders are shipped from Ukraine, personal data may be processed or transferred to the United States, Ukraine or other countries outside the European Economic Area.

Data transfers outside the European Economic Area are only carried out if there is a legal basis and appropriate safeguards as provided for in the GDPR. Depending on the circumstances, such safeguards may include:

  • the European Commission's decision on the adequacy of data protection;
  • standard contractual clauses approved by the European Commission;
  • other mechanisms expressly provided for in Chapter V of the GDPR.

7. Personal data retention period

Personal data is stored for no longer than is necessary to achieve the purposes for which it was collected.

In particular:

  • data related to the order and contract performance are stored for the duration of the contract performance, warranty and complaint service, as well as until the expiration of the deadlines for possible legal claims;
  • accounting and tax documents are stored for the periods established by applicable legislation;
  • data processed for marketing purposes are stored until consent is withdrawn or marketing activities are terminated;
  • data processed on the basis of legitimate interest are stored until the relevant purpose ceases or the user's justified objection is met;
  • technical logs and security data are retained for the period necessary to ensure the security of the Site, investigate incidents and prevent abuse;
  • Cookies are stored for the period specified in the settings of the respective cookie or until they are deleted by the user.

After the relevant period has expired, the data is deleted, depersonalized or blocked if their further storage is required by law.

8. User rights

According to GDPR, you have the right to:

  • obtain confirmation of whether your personal data is being processed and access it;
  • demand correction of inaccurate or incomplete data;
  • to request the deletion of personal data in cases provided for by law;
  • request restriction of processing of personal data;
  • receive data in a structured, commonly used and machine-readable format and transmit it to another controller, if the right to data portability applies;
  • object to processing carried out on the basis of the administrator's legitimate interest;
  • object at any time to the use of data for direct marketing;
  • withdraw previously given consent without affecting the lawfulness of processing carried out before its withdrawal;
  • not be subject to a decision based solely on automated processing and producing legal or similar significant effects, in the cases provided for by the GDPR;
  • file a complaint with the supervisory authority for personal data protection.

In Poland, the supervisory authority is the President of the Office for Personal Data Protection — Prezes Urzędu Ochrony Danych Osobowych, UODO .

9. Automated decision-making

We do not make decisions regarding users that are based solely on automated processing of personal data and produce legal or similar significant effects, unless the user has been expressly informed of such processing.

10. Cookies

The site uses cookies and similar technologies to ensure proper operation, save settings, function the shopping cart, place orders, protect against abuse, analyze traffic, and conduct marketing activities.

Cookies that are technically necessary for the operation of the Site or the provision of a service requested by the user may be used without prior consent.

Analytical, advertising and other optional cookies are only set after obtaining the user's consent. Such cookies should not be activated before consent is given.

The user can:

  • accept all optional cookies;
  • reject optional cookies;
  • provide separate consent for certain categories of cookies;
  • change your settings or withdraw your consent at any time, as easily as you gave it;
  • delete saved cookies through browser settings.

Refusing non-essential cookies should not prevent you from accessing the Site's core functionality. However, disabling technically necessary cookies in your browser settings may result in incorrect operation of the shopping cart, authorization, or checkout.

We apply appropriate organizational and technical measures to protect personal data against unauthorized access, accidental loss, unlawful destruction, alteration, disclosure or other unlawful processing.

No method of transmitting or storing information is completely secure. If we become aware of a personal data breach, we will act in accordance with the GDPR and applicable law.

We may periodically update this Policy in response to changes in legislation, methods of processing personal data, the operation of the Site, or the list of service providers.

The current version of the Policy is always published on this page. In the event of significant changes, we may additionally notify users in an accessible manner.
